Tomorrow, Jacob Garcia will appear in court to answer charges leveled by the Denver DA’s office.
They are: first degree murder and child abuse resulting in death.
Seems Garcia was watching his girlfriend’s year-and-a-half old son and something went wrong — terribly wrong.
Garcia told authorities it was all a terrible accident, but they clearly don’t believe him. Read the DA’s release below:

MAN CHARGED IN TODDLERS DEATHDenver District Attorney Mitch Morrissey has formally charged a man in connection with the death of a one-and-a-half year old toddler that took place on December 29, 2009.
Jacob Garcia (DOB: 09-18-78) is charged with first-degree murder (F1) and child abuse resulting in death (F2).
On December 29, 2009, about 8:30 p.m., Denver police officers responded to the 1300 block of South Stuart Street on a report of a child not breathing. The charges allege that Garcia was caring for his girlfriend’s son and caused injuries that led to his death.
Garcia is currently in custody at the Denver County Jail and is being held without bond. He is scheduled to appear in Denver County courtroom 472W on January 8, 2010 at 1:30 p.m. to be formally advised of his charges.
